NFAP study: Denial rate for H-1B applications is down to 3% for continued employment, 7.1% for new applications during 1st half of FY 2021

MUMBAI: The denial rate for H-1B visa petitions (applications) for continued employment (primarily for existing employees) was a mere 3% during the first two quarters of the fiscal year 2021 (October 1, 2020 up to March 31, 2021).

According to a study done by the National Foundation for American Policy (NFAP), a non-partisan public policy research organisation, this is a significant drop as compared to the 7% denial rate in the fiscal year 2020 and a much higher denial rate of 12% in the previous two fiscal years.

NFAP attributes this decline to the setting-aside of various restrictive policies introduced by the Trump administration by US courts. This also positively impacted new H-1B applications.
