ITServe Alliance obtains a preliminary injunction against the pay hike rule

ITServe Alliance, has obtained a preliminary injunction from a US district court (of New Jersey), against application of the interim final rule issued by the Department of Labour (DOL) in early October. This interim final rule (IFR), which came into effect from October 8, had significantly hiked wages for H-1B workers – upwards of 40%.

The Administrative Procedure Act requires a public notice and comment period. Comments from the public are vetting and a proper process is normally followed before rules are implemented. This process can take several months.
