TikTok sues US state over the “unconstitutional” ban
TikTok is suing Montana to prevent the state from banning the app due to national security concerns. The company asserts this action is “unlawful” and “unconstitutional.”
A lawsuit was filed by the social media app, owned by China’s ByteDance, on Monday in federal court. TikTok argues that the upcoming ban violates the First Amendment rights of the company and its users. According to the lawsuit, the ban on the app was unconstitutional as it prevented all speakers from using the platform for speech.
“We are challenging Montana’s unconstitutional TikTok ban to protect our business and the hundreds of thousands of TikTok users in Montana,” Brooke Oberwetter, a TikTok spokeswoman, said in a statement.
