Govt vs Twitter: Will courts decide who champions freedom of expression?
ET Now held a panel discussion on the ongoing tussle between the Government of India and social media website Twitter with panelists Apar Gupta, Co-founder, Internet Freedom Foundation and Arvind Gupta, Head, Digital India Foundation. Edited excerpts:
You have been saying that Twitter has not in fact lost intermediary status and that only a court can decide what happens next, but we have already seen an FIR naming Twitter. Can you explain the whole picture to us?
Apar Gupta: So, you have explained the fundamental basis of our immunity. It is given to an intermediary for any user post, this is done under the information technology act which defines what intermediary is and there is no process for registration. There is no process for grant of revocation for what is an intermediary. As per this definition there are further references to intermediaries such as social media companies under let us say the blocking powers or even under its immunity.
