BSNL’s “unacceptable in law” Tender Practices

Bharat Sanchar Nigam Ltd (BSNL) has not learnt any lesson from the 2G Spectrum scam judgment. After the cancellation of 122 licenses by the apex court, the President of India referred a set of questions to the Supreme Court for its response. On September 27, 2012 a five judge bench of the Supreme Court answered the queries raised in the Presidential reference. In this, Justice JS Khehar also gave a concurrent judgment, a part of this relates to answering the issue whether post-tender benefits can be passed on to a private party. Justice Khehar held that this is “unacceptable in law”.
